Short-term rentals in Miami: which buildings allow them and what to check before buying

In Miami, short-term rentals depend on three layers of rules: Florida law, city zoning and the declaration of condominium. Most residential towers in Brickell do not allow them. That is why investors look for buildings designed for it, such as Domus Brickell Center, and check the rules before signing.
Why asking "Can I Airbnb it?" is not enough
Florida law. Florida Statute 509.032 prevents local governments from banning vacation rentals, except for rules that already existed on June 1, 2011. That exception explains why Miami Beach can restrict them.
The city. Miami Beach only allows rentals of less than six months and one day in authorized zones and buildings, and it requires a city license and a resort tax account. In the City of Miami, CBS Miami reported in 2025 that short-term rentals are allowed in certain zones but not in Brickell's residential towers, and that there were more than 120 complaints between January and May of that year.
The condominium. The building's declaration can set minimum stays or limit how many times a year you can rent. Under Florida Statute 718.110, if the association changes those rules later, the change only applies to owners who approve it or who buy afterward.
What the projects we work with allow
| Project | Published rental rule |
|---|---|
| Domus Brickell Center | Marketed with no rental restrictions |
| Delano Residences, floors 20 to 47 | No rental restrictions, according to CondoBlackBook (official policy not yet published) |
| Delano Residences, floors 49 to 75 | No daily rentals, according to CondoBlackBook |
| One Twenty Brickell Signature | The official website advertises short-term rental flexibility |
| Parkside Residences at Brickell | Presented as short-term rental friendly; confirm in the documents |
| Viceroy Brickell (already delivered) | Up to 12 rentals a year, 30-day minimum |
The final rules are always in the condominium documents. We review them with you during the 15 days the law gives you to cancel the contract.
Buildings with an operator: the hands-off option
In a condo-hotel, the building itself runs the rentals. Domus Brickell Park, which opened in 2026, works this way: North Management handles bookings on the Domus platform, and owners can also use their unit as a home. Domus Brickell Center is the brand's next project, in a 35-story tower.
Questions we recommend asking
- What is the minimum stay, and how many times a year can I rent?
- Does the building have its own operator, and what does it charge?
- What licenses do I need, and who handles them?
- Under what conditions can I use my own unit?
Frequently asked questions
Can I run an Airbnb in any condo in Brickell? It is unlikely. Most residential buildings restrict it. Look for buildings designed for short-term rentals and confirm the rule in their documents.
Who pays taxes on short-term rental income? You as the owner, or the operator on your behalf. Read our guide on taxes for foreign owners.
